These Terms & Conditions govern your use of the DuckSmart mobile application and related services. By downloading, accessing, creating an account, or using DuckSmart, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the app.

These Terms include important information about your use of DuckSmart. In summary:

• DuckSmart is a planning, mapping, weather, logging, and hunting-history tool. 
• DuckSmart does not guarantee hunting success. 
• You are responsible for following all hunting laws, obtaining permission, confirming property access, and making safe decisions. 
• Map, property, weather, alert, and prediction data may be incomplete, delayed, inaccurate, or unavailable. 
• DuckSmart is not a legal survey and should not be used as your only source for property boundaries, ownership, or land access decisions. 
• Your saved pins, hunt logs, notes, photos, harvest records, and hunting history are tied to your account and are not displayed in a public feed for other users to browse. 
• If you purchase DuckSmart through Apple or Google, billing, subscription management, cancellations, and refunds are handled through the applicable app store. 

By downloading, accessing, creating an account, or using DuckSmart, you agree to be bound by these Terms & Conditions and our Privacy Policy.

If you use DuckSmart on behalf of a business, outfitter, guide service, club, or organization, you represent that you have authority to accept these Terms on their behalf.

DuckSmart is a mobile application built to support duck hunters with tools such as:

• Mapping features 
• Saved map pins 
• Property lines and property owner information 
• Weather information and alerts 
• Hunt logging 
• Notes and photos 
• Harvest tracking 
• Hunt history and analytics 
• Species identification information 
• Hunting preparation tools 

DuckSmart is intended to help users plan, track, and remember hunts. DuckSmart does not guarantee hunting success.

Conditions, weather, wildlife behavior, property access, regulations, and hunting outcomes vary and are beyond our control.

Subject to your compliance with these Terms, Mallard Works, LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, access, and use DuckSmart for your personal, lawful use.

DuckSmart is licensed to you, not sold. These Terms do not give you ownership of DuckSmart, its software, branding, designs, features, algorithms, content, or intellectual property.

You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, attempt to extract source code, or create derivative works from DuckSmart except as allowed by law or with written permission from Mallard Works, LLC.

DuckSmart provides information for general informational, recreational, and planning purposes only.

DuckSmart does not provide legal, safety, land access, wildlife management, emergency, or professional hunting advice.

You are solely responsible for:

• Knowing and following all local, state, and federal hunting laws 
• Verifying hunting seasons, limits, regulations, licenses, and permissions 
• Confirming property access and landowner permission 
• Making safe decisions in the field 
• Checking weather, water, road, and field conditions independently 
• Using proper judgment when hunting, boating, driving, scouting, or accessing land 

Do not rely on DuckSmart as your only source for safety, legal compliance, navigation, property access, or emergency decision-making.

DuckSmart may display mapping data, property boundaries, parcel information, and property owner information from third-party sources.

This information may be incomplete, delayed, inaccurate, or outdated. Property lines, ownership records, access rights, public/private boundaries, and legal restrictions may change.

DuckSmart is not a legal survey. DuckSmart should not be used for any purpose requiring precise legal boundary determinations.

For definitive property information, consult deeds, plats, surveys, county records, government records, the applicable landowner, or the appropriate authority.

You are responsible for verifying property access, legal boundaries, and landowner permission before entering, hunting, scouting, boating, parking, placing equipment, or retrieving game on any property.

DuckSmart may provide weather information, weather alerts, scores, predictions, insights, or recommendations based on available data.

All such information is an estimate and may be inaccurate, delayed, incomplete, or unavailable.

DuckSmart does not guarantee:

• Weather accuracy 
• Wildlife movement 
• Hunting success 
• Safe field conditions 
• Availability of ducks or other wildlife 
• Accuracy of recommendations, scores, alerts, or predictions 

Always verify weather, travel, water, and field conditions through trusted sources before making decisions.

Some features may require an account.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate information and update it when needed.

You may not share, sell, transfer, or misuse your account. You agree to notify us if you believe your account has been accessed without authorization.

DuckSmart may allow you to save or upload content, including map pins, hunt logs, notes, photos, harvest records, and other hunting-related information.

You retain ownership of the content you enter or upload into DuckSmart.

By using DuckSmart, you grant Mallard Works, LLC a limited license to store, process, display, and use your content as needed to operate the app, provide features, improve functionality, troubleshoot issues, and support your account.

You are responsible for the content you submit. You agree not to upload content that is unlawful, threatening, abusive, defamatory, invasive of privacy, infringing, obscene, or otherwise inappropriate.

DuckSmart is designed as a private personal hunting tool, not a public hunting report platform.

Your saved map pins, hunt logs, notes, photos, harvest records, and hunting history are tied to your account and are not displayed in a public feed for other users to browse.

DuckSmart does not sell your saved hunting locations, hunt logs, notes, photos, harvest history, or personal hunting data.

DuckSmart may offer paid subscriptions, in-app purchases, free trials, promotional access, or premium features.

Purchases made through the Apple App Store or Google Play Store are handled by those platforms and are subject to their payment terms, subscription rules, cancellation procedures, and refund policies.

If DuckSmart offers an auto-renewing subscription, your subscription may automatically renew unless canceled through your app store account before the renewal date. Apple describes auto-renewable subscriptions as ongoing access that automatically renews until the user chooses to cancel. 

Deleting DuckSmart from your device does not cancel a subscription. To stop recurring charges, you must cancel the subscription through the Apple App Store or Google Play Store account where the purchase was made.

Mallard Works, LLC does not control Apple or Google billing, subscription management, app store refund decisions, or cancellation processes. Google Play provides its own subscription cancellation and refund processes through Google Play. 

You are responsible for managing your subscription through the platform where you purchased it.

If you download DuckSmart through the Apple App Store or Google Play Store, your use of DuckSmart is also subject to the applicable app store’s terms and conditions.

Apple and Google are not responsible for providing maintenance or support for DuckSmart. Mallard Works, LLC is responsible for DuckSmart and for addressing questions, support requests, or claims related to the app, subject to these Terms.

DuckSmart may rely on third-party services for mapping, property information, weather data, analytics, notifications, cloud hosting, crash reporting, app stores, and other app functionality.

We are not responsible for interruptions, inaccuracies, delays, outages, policy changes, or errors caused by third-party services.

Third-party services may be governed by their own terms and privacy policies.

You agree not to:

• Use DuckSmart for unlawful purposes 
• Violate hunting, trespassing, wildlife, boating, firearm, or land access laws 
• Reverse engineer, copy, modify, or attempt to extract the app’s source code 
• Interfere with or disrupt the app, servers, networks, or security systems 
• Attempt to access another user’s account or data 
• Upload harmful code, malware, or abusive content 
• Misuse property, map, weather, or location data 
• Use DuckSmart in a way that harms Mallard Works, LLC, other users, or third parties 

DuckSmart, including its name, logo, branding, design, software, text, graphics, features, algorithms, and other content, is owned by Mallard Works, LLC or its licensors.

You may not copy, reproduce, distribute, modify, sell, reverse engineer, or create derivative works from DuckSmart without written permission.

These Terms do not grant you ownership of DuckSmart or any Mallard Works, LLC intellectual property.

We work to provide reliable service, but we do not guarantee that user content, saved locations, notes, photos, hunt logs, or other data will never be lost, corrupted, interrupted, or unavailable.

You are responsible for keeping any separate records or backups you consider important.

DuckSmart may change, update, suspend, or discontinue features at any time.

We may experience outages, bugs, maintenance periods, data delays, third-party service interruptions, or other technical issues.

We are not responsible for losses or damages caused by service interruptions, unavailable features, delayed data, or third-party provider issues.

We may suspend or terminate your access to DuckSmart if you violate these Terms, misuse the app, create risk for Mallard Works, LLC or other users, or use the app unlawfully.

You may stop using DuckSmart at any time.

Termination may result in loss of access to your account, saved data, and app features.

DuckSmart is provided “as is” and “as available.”

To the fullest extent permitted by law, Mallard Works, LLC makes no warranties, express or implied, about DuckSmart, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, or non-infringement.

Use DuckSmart at your own discretion and risk.

To the fullest extent permitted by law, Mallard Works, LLC, DuckSmart, and their owners, employees, contractors, partners, service providers, and affiliates are not liable for:

• Missed hunting opportunities 
• Inaccurate maps, property lines, or property ownership data 
• Weather inaccuracies or delayed alerts 
• Personal injury or death 
• Property damage 
• Trespass, access disputes, or legal violations 
• Loss of data 
• Loss of photos, notes, pins, or hunt logs 
• Financial loss 
• App outages or third-party service failures 
• Decisions made based on app information 

Use of DuckSmart is at your own risk.

You agree to defend, indemnify, and hold harmless Mallard Works, LLC, DuckSmart, and their owners, employees, contractors, partners, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from:

• Your use of DuckSmart 
• Your violation of these Terms 
• Your violation of laws or regulations 
• Your uploaded content 
• Your hunting, scouting, boating, driving, land access, or field decisions 
• Your infringement of another person’s rights 

Your use of DuckSmart is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, store, and protect information, including location data, hunt logs, saved pins, notes, photos, and account information.

You should review the Privacy Policy before using DuckSmart.

We may update these Terms from time to time.

If we make changes, we will update the effective date above. Continued use of DuckSmart after updated Terms are posted means you accept the revised Terms.

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.
